1. Agreement to Terms

By accessing or using our services (including our website, audits, advice, product sales, and installations), the client agrees to be bound by these Terms of Service. These terms constitute a legally binding agreement between the client and GreenWatts Group Pty Ltd (referred to as "we," "us," or "our").

2. Description of Services

Energy Efficiency Auditing and Advice: Identify Energy Waste: The primary goal is to pinpoint areas where energy is being used inefficiently or unnecessarily. This could involve leaky insulation, outdated equipment, inefficient lighting, poorly managed HVAC systems, or even behavioural patterns of energy users.   Quantify Energy Consumption: An audit establishes a baseline of current energy usage, breaking it down by different systems and processes. This data is crucial for understanding where the biggest energy costs lie.   Pinpoint Cost-Saving Opportunities: By identifying inefficiencies, the audit highlights specific actions that can be taken to reduce energy consumption and, consequently, lower energy bills. These recommendations often come with estimated cost savings and payback periods.   Reduce Environmental Impact (Carbon Footprint): Lowering energy consumption directly translates to a smaller carbon footprint. This includes partnering with fully qualified, compliant, accredited and insured trades experts.

3. Client Obligations

Responsibilities of our clients: Client(s) must provide accurate and complete information necessary for the provision of services. Granting access to their premises for audits and installations. Ensuring a safe working environment for our personnel. Client(s) must comply with all applicable laws and regulations. Client(s) agrees to making timely payments as agreed upon.

4. Orders, Pricing, and Payment

Orders: Explain the process for placing orders for products and services. Specify whether a quotation or proposal is required and how it becomes a binding agreement. Pricing: Clearly state your pricing structure, including whether prices are inclusive or exclusive of GST and any other applicable taxes. Mention potential variations in pricing based on project complexity or unforeseen circumstances. Payment Terms: Products and Services payable via bank transfer. Products are payable in full prior to shipment. Services including installations – 60% deposit after signed quotation/agreement, balance payable on completion of installation. Quotations and Estimates: Quotations are valid for 30 days Quotations including government rebates are subject to rebate values at the time of signed quotation/agreement.

5. Installation Services (If Applicable)

Process for installations: Scheduling - Minimum 7 days notice Client must provide access to site Client must agree to providing temporary restricted work area for installers to park work vehicles, store new units/equipment, leave old unit and all rubbish. Client must be available from the start and conclusion of the installation GreenWatts Group installers/contractors will work to standards for workmanship and compliance with relevant Australian and Victorian building codes and electrical standards.

6. Product Warranties

Product warranties are provided by the manufacturer and outlined in the process for warranty claims. Installation warranty as per industry standards.

7. Intellectual Property

All intellectual property rights related to your services, including reports, methodologies, and website content, belong to GreenWatts Group Pty Ltd.

8. Confidentiality

GreenWatts Group are committed to keeping the client(s) confidential information secure. Client(s) has an obligation to maintain the confidentiality of our proprietary information.

9. Limitation of Liability

GreenWatts Group Pty Ltd is a facilitator of renewable equipment and services. All products and services are provided by Australian registered businesses and their compliance to regulations. They will have their own limitations on direct damages, indirect damages, consequential losses, and loss of profits.

10. Indemnification

The client agrees to indemnify and hold GreenWatts Group Pty Ltd harmless from any claims, losses, damages, liabilities, costs, and expenses arising out of their breach of these Terms or their negligent or wrongful acts.

11. Termination

Termination of agreement is limited to 5 working days. GreenWatts Group Pty Ltd reserves the right to determine fair and reasonable conditions for early termination. If termination is within the 5 working days, then any expenses incurred will need to be deducted from the initial deposit.

12. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of Victoria, Australia. Preferred method for resolving disputes, such as negotiation, mediation, or litigation in the courts of Victoria.

13. Amendments to Terms of Service

We reserve the right to modify these Terms of Service at any time. Changes will be communicated to clients via posting on our website and/or email notification. Continued use of your services after the changes constitute acceptance of the revised Terms.

14. Severability

Include a clause stating that if any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.  

15. Entire Agreement

These Terms of Service constitute the entire agreement between the parties and supersede all prior or contemporaneous communications and proposals, whether oral or written.
